Intex barred from selling Aqua-branded mobiles by Delhi High Court

The Delhi High Court has barred Intex from selling Aqua branded mobile phones. The court was acting on a trademark infringement petition that was filed by Aqua Mobiles. The decision would deal a major blow to the company considering a majority of its smartphones sport the Aqua branding. Besides Aqua, Intex also sells Android-powered smartphones under the 'Cloud' brand name. 

Intex plans to file an appeal challenging the decision. In a statement, the company said, “Intex has decided to challenge and file an appeal to this order dated 24.12.16 preferably before Division bench of Delhi High Court. As the matter is sub-judice, hence we cannot comment upon further.”

Intex is also dealing with falling sales as of late. According to a report by IDC, the smartphone maker slipped to the number fourth sport in the Indian smartphone market in Q2 2016. However, by Q3 2016, it was out of the top five altogether. Chinese smartphone manufacturer, Xiaomi had taken the fourth spot in its place as its shipments doubled compared to the previous quarter.

Besides smartphones, Intex’s product portfolio also includes smart watches, TVs, refrigerators, and more.
