OnePlus One back on sale, Delhi High court lifts ban

OnePlus gets green flag from Delhi High Court to resume sale of its One smartphone in India.

The Delhi High Court has lifted the sale ban on the OnePlus One in India. OnePlus was recently banned from selling its “One” smartphone because of an injunction filed by Micromax. Micromax filed the injunction because it has an exclusive licensing agreement with Cyanogen in India and OnePlus was using the Cyanogen branding as well as the software for its One smartphone.

According to the new motion by Justices Pradeep Nandrajog and RK Gauba on Wednesday, OnePlus is allowed to sell its One phone for now but the case shall be heard and decided afresh on January 7 by a single judge. The court has also directed Cyanogen and OnePlus to file written statements on the matter within two weeks.

The judges reached an understanding that the devices in question, the Micromax Yu Yureka and the OnePlus One were addressing two different segments of customers. The court order said "The consumer of one product is a mid-segment consumer and the consumer of the other product is a high-end consumer, and thus, prima-facie, neither competes nor eats into the territory of the other”. The OnePlus One is sold at Rs. 21,999 and the Micromax Eureka YU smartphone for Rs. 8,999.
